Wyoming Dui Laws are very strict laws concerning driving while under the influence. If you are driving erratically or you are showing signs of intoxication, you can be pulled over and tested further to see what your blood alcohol level is. A blood alcohol concentration (BAC) of .08 or above will mean that you will be arrested for DUI. If you are a commercial driver, this limit will be decreased to .04 and a driver under the age of 21 will have an even lower limit of .02. If you are found to be at these limits or lower, you will be facing some strict penalties and punishments.
First DUI Offense
The first DUI conviction that you have will mean that you will lose your license for a period of at least 90 days. As far as jail time, there is no minimum sentence, but you can be sentenced to up to 6 months. As far as fines, you will be facing amounts up to $750 and you will have to pay for substance abuse assessment prior to sentencing as well.
Second DUI Offense
The second DUI offense within a period of 5 years will mean that you will be facing a license suspension of upon year and to get your license reinstated, you will have to include an ignition interlock device on your car for at least one year after your suspension. Jail time will be a minimum of 7 days in jail and you may have to spend up to 6 months in jail, depending upon the arrest factors. Fines will be up to $750 and this amount will be increased by other fines and fees that are associated with fulfilling your sentence, as well as court fees. Prior to your sentencing, you will be required to have a substance abuse assessment done as well.
Third DUI Offense
A third DUI offense in the State of Wyoming will mean that you will lose your license for a period of 3 years. If your conviction is within 5 years of a previous conviction, you will be looking at a minimum of 30 days in jail up to 6 months in jail. You can have 15 days of your jail time suspended if you complete an inpatient treatment program. Fines will be anywhere from $750 to $3000 and you will be responsible for other costs associated with your sentencing and court fees as well. It can really add up as far as time and fines, so you want to make a better choice and not get behind the wheel of your car if you are under the influence.
Fourth DWUI Offense
A fourth DWUI conviction will result in many different restrictions on your life. The first is that you will lose your license for at least five years and your license can only be reinstated at this point if you have an ignition interlock device installed on your vehicle. As far as jail time, you can be sentence to up to 2 years in jail and you can be fined up to $10,000. This amount can climb substantially, however, when you add in the other fees that are associated with the courts and with carrying out your sentence, including the installation and rental of an ignition interlock device.
